Broker Awarded Lease Commission
A brokerage that helped a landlord and its tenant renew a long-term lease is entitled to its commission even though the agreed-to rent amount was not established until after the expiration of the brokerage’s commission agreement, said the Missouri Court of Appeals, Western District, reversing the lower court. The landlord argued the commission wasn’t owed since the rent amount wasn’t set until after expiration of the agreement, but the appeals court said the commission was due at time the lease agreement was signed, which was before expiration of the commission agreement.
